Les présentes Conditions Générales de Vente (les « Conditions ») régissent la fourniture de services par Marlowe Real Estate Group Ltd (« Marlowe », « nous », « notre ») à votre égard (le « Client », « vous », « votre »).
En passant commande, en achetant une offre ou en utilisant nos services, vous reconnaissez avoir pris connaissance des présentes Conditions et les accepter sans réserve.

Nous proposons des services de marketing immobilier digital, incluant notamment :

La mise en scène virtuelle assistée par intelligence artificielle

Le réaménagement intérieur digital

L’ameublement virtuel

L’optimisation et l’amélioration d’images
-
La création de visuels marketing
-
La production de visuels avant/après
-
La conception de supports de présentation immobilière
L’ensemble des prestations est fourni exclusivement sous format numérique.
Aucune mise en scène physique, aucun travaux de construction ni intervention sur site ne sont réalisés.
3. Commande et acceptation
Les commandes peuvent être effectuées via notre site internet, par courrier électronique ou par toute plateforme convenue entre les parties.
La commande devient ferme et définitive à réception du paiement.
Nous nous réservons le droit de refuser toute commande, à notre seule discrétion.
4. Responsabilités du Client
En passant commande, le Client s’engage à :

Fournir des images exactes et de qualité suffisante pour permettre une mise en scène digitale appropriée ;
-
Garantir qu’il est titulaire des droits de propriété ou qu’il dispose de l’ensemble des droits et autorisations nécessaires pour utiliser et modifier les éléments transmis ;
-
Garantir que les images soumises ne portent atteinte à aucun droit d’auteur, marque, droit à l’image, droit à la vie privée ou à tout autre droit de tiers ;
-
Confirmer que les autorisations nécessaires ont été obtenues auprès des propriétaires du bien, le cas échéant ;
-
Veiller à ce qu’aucun contenu confidentiel, sensible ou illicite ne soit inclus dans les éléments transmis ;
-
Fournir des instructions claires, précises et complètes concernant les préférences stylistiques et exigences spécifiques.
4.1 Exactitude des éléments transmis
Le Client est seul responsable de l’exactitude, de la légalité et de l’exhaustivité des images et informations communiquées.
Marlowe Real Estate Group Ltd ne saurait être tenue responsable :

Des erreurs résultant d’éléments inexacts ou incomplets fournis par le Client ;
-
Des limitations de qualité liées à des images de faible résolution ou de qualité insuffisante ;
-
Des inexactitudes ou représentations trompeuses figurant dans les photographies d’origine ;
-
Des retards résultant d’instructions manquantes, imprécises ou ambiguës.
4.2 Responsabilité en matière de conformité
Le Client demeure entièrement responsable :
-
De s’assurer que l’utilisation des visuels mis en scène virtuellement respecte les règles et standards applicables en matière de publicité ;
-
De procéder, le cas échéant, à une mention claire indiquant que les images ont été modifiées numériquement ;
-
Du respect des réglementations relatives au marketing immobilier ;
-
Du respect des obligations légales applicables aux professionnels de l’immobilier et à la protection des consommateurs.
Le Client s’engage à veiller à ce que toute utilisation des visuels mis en scène dans le cadre d’une communication commerciale mentionne clairement leur caractère numérique, conformément aux recommandations et réglementations en vigueur.

5. Délais de livraison
5.1 Délais standards de réalisation
Les délais de livraison estimatifs sont les suivants :

Offre Starter & Offre Pro : environ 72 heures
-
Offre Agence : environ 48 heures (traitement prioritaire)
Le délai de livraison ne commence à courir qu’à compter de :
-
La réception intégrale du paiement ; et
-
La transmission complète, exploitable et conforme de l’ensemble des images, instructions et éléments requis.
Les délais sont calculés à partir du jour ouvré suivant la réception de l’ensemble des éléments nécessaires.
Par « jour ouvré », il convient d’entendre tout jour autre qu’un samedi, un dimanche ou un jour férié légal en Angleterre et au Pays de Galles.

5.2 Révisions
Le délai de livraison mentionné ci-dessus concerne exclusivement la première remise des visuels et n’inclut pas les éventuelles demandes de modification.
Chaque demande de révision constitue une nouvelle étape de production et peut entraîner un délai supplémentaire estimé entre 24 et 48 heures, en fonction de la complexité du projet et de la charge de travail.

5.3 Délais indicatifs et retards
L’ensemble des délais indiqués est fourni à titre estimatif et ne constitue en aucun cas une garantie contractuelle.
Marlowe Real Estate Group Ltd ne pourra être tenue responsable des retards résultant notamment :

De la transmission incomplète, tardive ou imprécise des éléments par le Client ;
-
D’un délai de réponse du Client ;
-
De problèmes techniques indépendants de notre volonté raisonnable ;
-
D’interruptions ou dysfonctionnements de services tiers (y compris plateformes d’hébergement ou solutions d’intelligence artificielle) ;
-
D’un volume de commandes exceptionnellement élevé ;
-
Des jours fériés ou week-ends.
En cas de retard imprévu, nous nous efforcerons d’en informer le Client dans les meilleurs délais.

6. Revisions
Unless otherwise stated, packages include the number of revisions specified at purchase. Additional revisions are charged separately at £29 per revised photo. Revision requests must be submitted clearly and in writing. Major changes to brief, style, or scope may be treated as a new order.
7. Pricing and Payment
All prices are displayed in GBP (£) unless stated otherwise. Payment must be made in full before work begins. We accept payments via approved online payment providers. Prices may change at any time without prior notice.
8. Refunds & Cancellations
Due to the digital and customised nature of our services, all orders are subject to the terms below.

8.1 Cancellation Before Work Commences
An order may be cancelled for a partial refund only if cancellation is requested in writing before any work has commenced.
For the purposes of these Terms, work shall be deemed to have commenced once:

Project files have been accessed or reviewed
-
Production time has been allocated
-
Editing, staging, rendering, or design work has begun

If cancellation is approved before work has commenced, a refund of 80% of the total order value will be issued.
The remaining 20% is retained to cover non-recoverable payment processing fees, administrative handling, and transaction costs incurred at the time of purchase.

8.2 After Work Has Commenced
Once production has commenced, the order is considered in progress and becomes non-refundable.
Due to the personalised and digital nature of the services, no refunds will be provided for:

Dissatisfaction with artistic style or creative interpretation
-
Subjective design preferences
-
Change of mind
-
Market performance or sales results
-
Errors, omissions, or unclear instructions provided by the Client

A service shall be deemed delivered once the ordered digital images have been provided to the Client.
Dissatisfaction with visual outcome, realism, design choices, or staging style shall not constitute failure to deliver.

8.3 Failure to Deliver
A refund (partial or full) will only be considered in circumstances where no deliverables have been supplied within a reasonable timeframe following receipt of full payment and all required materials.
Such decisions remain at the discretion of Marlowe Real Estate Group Ltd.

8.4 Refund Requests
All refund or cancellation requests must be submitted in writing within 7 days of delivery (where applicable).
9. Intellectual Property & License
9.1 Ownership
All intellectual property rights in and to:

Digitally staged images
-
Edited or redesigned visuals
-
Drafts and concepts
-
Underlying AI prompts, models, workflows, systems, and processes
​
remain the exclusive property of Marlowe Real Estate Group Ltd.
Nothing in these Terms transfers ownership of copyright to the Client.​

9.2 Licence to Use
Upon full payment, the Client is granted a non-exclusive, non-transferable, non-sublicensable licence to use the final delivered images solely for marketing and promotional purposes relating to the specific property for which the images were commissioned.
​
Permitted uses include:

Property listings
-
Estate agency websites
-
Social media marketing
-
Printed brochures and materials
-
Online advertisements
The licence applies only to the specific property and listing for which the images were created.

9.3 Restrictions
The Client may not:

Resell or license the images as standalone products
-
Transfer the licence to another party without written consent
-
Use the images for a different property
-
Modify the images in a way that removes staging disclosure where required
-
Claim authorship or ownership
-
Reverse engineer, replicate, or use the images to develop competing virtual staging services
-
Extract templates, assets, prompts, or production methods

9.4 Portfolio Use
Marlowe Real Estate Group Ltd reserves the right to use delivered images for portfolio, website, social media, and marketing purposes, including before-and-after examples, unless the Client requests confidentiality in writing prior to project commencement.
Where requested, reasonable efforts will be made to anonymise property details.
10. Disclaimer on Realism, Accuracy & Use
Virtual staging, redesign, and digitally altered images produced by Marlowe Real Estate Group Ltd are created for illustrative, decorative, and marketing purposes only.
They are visual representations and do not reflect the actual condition, layout, dimensions, fixtures, finishes, materials, lighting, or furnishings of the property.

10.1 No Guarantee of Accuracy
Rendered images may:

Include digitally added furniture, décor, lighting, textures, or finishes
-
Modify colours, surfaces, or visual presentation
-
Depict items, materials, or layouts that do not exist in the physical property
-
Represent furniture, décor, or materials that may not exist in the market or be commercially available

No representation or warranty is made that any depicted furniture, finishes, materials, or design elements:

Exist in the form shown
-
Are available for purchase
-
Can be installed in the property
-
Comply with building regulations
​
10.2 No Structural or Technical Representation
Images are not architectural drawings, surveys, or technical documents.
​
They must not be relied upon for:

Structural interpretation
-
Measurements or dimensions
-
Building compliance
-
Renovation decisions
-
Construction planning
-
Valuations

Any reliance placed on staged images is at the viewer’s own risk.
​
10.3 Marketing & Regulatory Responsibility
Clients remain solely responsible for:

Ensuring compliance with advertising standards
-
Ensuring compliance with property marketing regulations
-
Providing appropriate disclosure that images are virtually staged
-
Ensuring listings do not mislead prospective buyers or tenants

Marlowe Real Estate Group Ltd accepts no liability for:

Buyer or tenant misunderstandings
-
Regulatory investigations
-
Advertising complaints
-
Valuation outcomes
-
Sales performance
-
Marketing results

To the fullest extent permitted by law, Marlowe Real Estate Group Ltd shall not be liable for any indirect, consequential, or economic loss arising from the use of digitally staged or redesigned images.
11. Limitation of Liability
11.1. Nothing in these Terms shall limit or exclude our liability for:

Death or personal injury caused by our negligence

Fraud or fraudulent misrepresentation
-
Any matter which cannot be excluded or limited under applicable law

11.2. Subject to clause 11.1, to the maximum extent permitted by law, Marlowe Real Estate Group Ltd shall not be liable for any loss, damage, or expense arising from or in connection with the use of our services, including but not limited to:

Loss of profits or revenue

Loss of business or commercial opportunity
-
Loss of sales or property transactions
-
Loss of anticipated savings
-
Loss of data
-
Reputational damage
-
Marketing performance or sales outcomes
-
Buyer, tenant, or third-party claims
-
Indirect, incidental, special, or consequential losses

11.3. We do not guarantee any specific commercial, marketing, sales, or financial outcome from the use of our services.

11.4. Our services are provided for marketing and illustrative purposes only. We accept no responsibility for decisions made by clients, buyers, tenants, agents, or third parties based on the delivered images.
​
11.5. Subject to clause 11.1, our total aggregate liability in respect of any claim arising under these Terms shall be limited to the total amount paid by the Client for the relevant service.
12. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including but not limited to:

AI provider failures

Cyber incidents

Natural disasters
-
Government actions
13. Confidentiality & Data Protection
We process personal data in accordance with UK GDPR and our Privacy Policy. Client materials are handled confidentially. Client materials may be retained for operational, support, or legal purposes for a reasonable period after project completion. We do not sell or share client data with third parties without consent.
14. Suspension & Termination
14.1 Right to Suspend or Terminate
Marlowe Real Estate Group Ltd reserves the right to suspend or terminate services immediately, without liability, if:

Payment is overdue or reversed
-
A chargeback or payment dispute is initiated
-
The Client breaches these Terms
-
The Client provides unlawful, infringing, or misleading materials
-
Abuse, harassment, or misuse of services occurs
-
Continued provision of services would expose Marlowe Real Estate Group Ltd to legal, regulatory, or reputational risk
-
The Client engages in conduct that is abusive, threatening, defamatory, discriminatory, harassing, or otherwise inappropriate toward any employee, contractor, representative, or affiliated partner of Marlowe Real Estate Group Ltd, whether in written, verbal, or digital communication

14.2 Effect of Termination
Termination shall not:

Entitle the Client to a refund for work already completed or in progress

Affect any outstanding payment obligations
​
Where services are terminated due to Client breach, any amounts paid shall be non-refundable.

15. Third-Party Platforms
Our services may rely on third-party providers, including but not limited to:

AI generation platforms

Cloud hosting services

Payment processors

Website infrastructure providers

Software tools and integrations

While we carefully select reputable providers, we do not control and are not responsible for:

Service outages
-
Technical disruptions
-
Platform errors
-
Changes in third-party policies

Pricing changes imposed by third-party providers

Performance limitations of third-party systems

Marlowe Real Estate Group Ltd shall not be liable for delays, service interruptions, or performance issues arising from circumstances beyond our reasonable control, including failures or limitations of third-party platforms.
In the event of a third-party outage or disruption, reasonable efforts will be made to resume services as soon as practicable.
16. Complaints & Dispute Resolution

We aim to resolve disputes amicably within 30 days.
If disputes cannot be resolved amicably within 30 days, the Parties agree to use a recognised mediator before commencing court proceedings.
17. Governing Lax & Jurisdiction
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the English courts.
18. Amendments
We may update these Terms at any time.
Updated versions will be published on our website.
Continued use of our services constitutes acceptance of revised Terms.

If any provision is found unenforceable, that provision shall be severed and the remainder shall continue in full force.
